Bangor Makes It Illegal to Smoke in Cars

BANGOR, Maine (AP) -- The Bangor City Council approved a measure Monday that prohibits people from smoking in vehicles when children are present.

When the law goes into effect next week, Bangor will become the first municipality in Maine to have such a law. Similar statewide measures have been adopted in Arkansas and Louisiana and are under consideration in several other states.

Pediatrician Robert Holmberg said the evidence is "incontrovertible" that exposure to cigarette smoke causes medical disorders in children, including asthma, bronchitis, ear infections and heart disease.

"Children are the most in need of the protection by public policy, because they can't protect themselves," he said.

But the ordinance also had its critics.

Aaron Prill of Bangor told the council that the ordinance was a "feel-good option" that was not intended to protect children but rather to "moralize" against smokers. Most smokers have enough common sense not to smoke around children, he said

A good thing, no question. They should go after pregnant smokers next.

A bad thing. It's just another way for the powers that be to grab more money from folks. I don't smoke and see it as a nasty habit, but we have waaaaay too many laws as is.

I have to take time out of my already too busy schedule to go to a town meeting to talk the local dumbassess out of making it a local law that all pets have to be registered, to the point that they can have the authorities come up into your house, unannounced and uninvited, and take your pets. All these laws being made for "our own good" just cost us more money, more hastle, and ultimately push us one step closer to the reality of a George Orwell-esque society. No thanks.

It's too bad they have to do this, but alot of people have no common sense nor respect.We have a local case going on where a pregnant mother left 2 of her 10 kids in a mini-van (ages 3,5 and 10 mos) and went into K-Mart to shop for some jewelry. She is not married and is on state aid and has 10 kids from 7 different sperm donors. While she was in shopping for 3 hours (this was in Feb 2006) the 5 yr. old boy found a lighter as mom was a heavy smoker (which us tax payers were buying her cigarettes by the way), The 5 year old set fire to some paper in the car as it was full of trash and the car was immediately engulfed in flames and he and his 6 yr old sister were yanked out by some passerbuys but since the baby wasn't fastened in its car seat properly, fell to the floor of the car face first and perrished and the two kids who got out failed to mention that their baby brother was still trapped inside. When the Mother finally came out after purchasing 2 rings and upon finding out what happened was angered because she didn't think anything would happen as she thought she was entiteled to a little shopping away from the kids as it's been very hectic lately. The mom lost all of the remaining 9 children to state agencies as she was proven unfit and none of the sperm donors wanted anything to do with the kids. In November she gave birth to number 11 and is allowed to keep it, well at least till she goes to prison.

I have to mostly agree with Hutter here ... too many damn laws as it is, however oneno's horrid example is a reminder that there will always be idiotic, ignorant and disrespectful people.

Here in California, the city of Santa Monica banned smoking outdoors, which to me is too extreme. And that law about pets needing to be registered -- very Orwellian indeed. That's to speak nothing of all those bullshit outdated or unenforceable laws that each state seems to have. I think each law should must first pass with flying colors using a bullshit detector and a common-sensometer. How 'bout those ridiculous anti-sodomy laws, like in Texas? At some point, we may have to reconsider how much of a "free country" we are actually living in. [V]

I get what you guys are saying but the fact is that there will always be stupid people. And I think it's unfair that others have to suffer for the ignorance of those half-brains...especially children [V]

I'm with Marv and Oneno on this one. People are so fuckin stupid that it effects and hurts other people. It is a shame that they have to pass laws but if it stops the idiots then so be it. Seat belt Law? I remember people yelling about this becoming a police state and Nazi this and that. But in the end lives are saved. I just wish idiots can be put in jail.

Another intrusion. If someone wrings their hands and says, "it's for the children", then lawmakers seem have a contentst on how quickly they can hand over our rights. It's probably to avoid commercials from an opponent in the next election that say, "Why does Councilman Bob hate children?"

It's a shame that there are so many stupid and common sense-less people, but stupid is as stupid does. Enacting a law isn't going to make people smarter. For example, people smoke and seem to think that lung cancer can't/won't happen to them. People purposely don't buckle up or wear motorcycle helmets, despite very real evidence that Newton's Laws of Motion apply to bodies when a vehicle comes to a very sudden stop.

I see both sides on this, but like with smoking, they ban smoking all over the place and now I can breath. I can go to a bar or out to eat and not have that smoke making me sick or worse. Because they enforce it. Quality of life laws are great.

I usually get nervous whenever a law is proposed to limit our freedoms. But here is where I think the law is justified because kids are helpless to avoid the smoke within the tiny, confined space of a car. The comment was made that most adults have the common sense not to smoke around children. But for the few idiots who lack that common sense, the law is needed. I know from first hand experience.

When I was a kid my four parents (mom and stepfather, dad and stepmother) all smoked like fiends. They smoked in the house, so we always had filthy ashtrays and sticky brown tar on the walls. Yuk. And they smoked in the car--with the windows up because "it's freezing outside". My sisters and I would be gagging on the smoke and rubbing our burning eyes. Then we'd arrive at school or church and when the doors opened, clouds of smoke would roll out. I hated always smelling like an ashtray. I remember being very angry at my parents for making us sick and for fouling my hair and wardrobe. I would have secretly cheered if my parents had been pulled over and ticketed for smoking in the car.

Besides, the law doesn't prohibit all smoking in cars. Only when there are children under 18 inside.
