I would say YES, YES YES. Even if their later stuff was not really new wave, I still think they're a new wave band because they were one of the main groups that started the genre.

I can see plagiarism's point and I have no problem with it.

Plagiarism, I'm not sure if you were being facetious with your reply. But, if not, I'll add mine.

I'm the same way about The Cure. All was good until "hot Robert" became "fat Robert". That's when they died for me.

I know it sounds like a dumb question but I've actually heard people insist DM are NOT new wave. which to me is like saying Tupac is not hip hop

They're kind of hard to categorize. Like A-ha, their earlier stuff is pure synthpop but they incorporated much more prominent non-synthesized instruments in their later works. I just call them synthpop (Pretty dark synthpop at times, mind you) and be done with it. For me, new wave had more guitar presence than they had, like Duran Duran and The Fixx. The Mode were much for synth orientated.
But, hey, new wave is such an umbrella term, you decide! Its different for everyone : D
