eight6, no offense, I was not trying to defend the streetracers. I was just trying to point out that the legal system as it stands.

I agree the laws should be stricter as well. As for that cabbie, that sentence really sucked. The folks with the money for good lawyers always seem to get it easy.

BTW, there was something else I forgot to mention. The new laws also make it illegal for nitrous oxide boosters in the cars. If they are caught the cars will be seized on the spot. Nice to see they are finally getting serious with some of the penalties.

On the bright side the laws were changed this week for streetracing and dangerous driving. Anyone caught doing over 50 km/h (thats 30 mph for our southern friends) automatically has their car seized for 7 days and loses their license for 7 days plus an autmatic court date with a minimum fine of $2000. They have been impounded vehicles with a vengeance this week.

50 k over you say. In a couple of weeks there won't be any cars on the 401, they'll all be in the pound.
[/quote]

Yup they already nailed quite a few especially out my way. 2 motorcyclists from Quebec got nailed yesterday doing 150k in a 50k zone. Both lost their bikes for a week and had their licenses revoked for week. Must have been a fun ride home on the bus. They also picked up 2 in rental cars so they will have pay an extra weeks rental on top of all the fines.

They should make them at the very least pay for the girls college (anywhere she wants to go). I wonder if there will be a civil case.

Very sad. [:(]

Haven't heard anything about a civil suit yet.

This weekends totals will be interesting. I'd say they're good for a couple of hundred impounds over the next 3 days alone.

*Update* - This weekends impound total - 330 vehicles.

<br>Obviously not knowing all the facts, but I have always thought, regardless of circumstance, that if you turn in front of someone, you are at fault, regardless of their speed, running a red light, etc.

Is this true everywhere ?
I ask b/c one year ago this week, I was T-boned right in front of my school. Destroyed my '74 Duster. I was OK, thank goodness---spent all day at the ER getting CAT scans, etc.
I was knocked unconscious, so I never talked to police or insurance.
My husband & I were just talking about this b/c I never received a copy of the police report. Also, my insurance never contacted me, so I assume I wasn't at fault. I have half-heartedly tried to contact the Place Where Records Are Kept to try to get a copy of the police report.
Well...last week came time for us to pay for the year for our auto insurance. Right on the paperwork it listed that accident as my fault ("At-Fault"). I was surprised. #1: I didn't think getting T-boned by a ginormous F-350 who was, according to all witnesses, barreling down the street in far excess of the speed limit would be my fault. (I was in the left-turn bay making a turn.) #2. If you're at fault, doesn't your insurance give you a call to get your reporting of the events ? Don't the police have to talk to you and file a report ? Or was the fact that I was knocked unconscious preclude all that ? In other words, so getting T-boned is always your fault ? Even if I had plenty of space/ time to turn but this guy was flying down the street anyway ?

p.s. forgive me for being off topic...alcohol had nothing to do with that accident.[:)]

KYYX--I was T-boned in 1996 and within days, an insurance rep (for the lady who hit me) was calling and offering to pay medical bills and offering $$$ for pain and suffering. I wasn't knocked out, so the police took all the information at the scene. A few days later, my insurance company called me to get a statement.

I never saw a copy of the police report, either, but since the lady's insurance company footed the bill for my hospital stay and several weeks of physical therapy and other expenses, I didn't actively hunt one down. (I think I just really didn't want to read about what had happened. I didn't want to re-live it).

My insurance rate did go up the next time I renewed my policy even though the wreck was NOT MY FAULT. Just by BEING in an accident, it caused an increase in my rate. That was 11 years, and it still pisses me off when I think about it.

My situation is different from yours in that I was just motoring down the road and was hit by some old bag who crossed 5 lanes and hit me because "the sun was in her eyes." (I don't know about y'all, but when the sun's in MY eyes, I tend to slow down and watch what I'm doing....) I wouldn't think that you were at fault, but it's definitely worth investigating. If just being in a wreck can adversely affect someone's insurance rates/driving record, then I'd hate to think what being at-fault can do to them.

true, but like you, I haven't tried too hard to track it down, b/c of not really wanting to see what it says, nor "re-live" it.
I seem to be lucky, b/c my rates haven't gone up that much. Getting an old car destroyed and then buying a new used little old car may have something to do with it.
I was just wondering b/c insurance, the cops, or the ambulance-chasers never got hold of me. It was as if it never happened.
thanks for sharing, bmg.[:)]

I have been through this also. I will give some advice. NEVER even speak to the other persons insurance! EVER! They record all phone calls they make to you in order to use it against you. They can turn it around and sue you. You MUST make out a police report right away and call your insurance after that. Your rates should never go up if you are not at fault. By not going after her ins. co....your rates went up. I called my ins. agent and asked and they told me if I am not at fault, I will not pay any more. My ins. co. went after the other guys ins. co. I never spoke to anyone but my agent and my lawyer.I never paid a dime for my car repairs, therapy, anything. Then I got paid$!Not a ton but something. My rates never went up.
