What a crappy day

Postby enzfan » Thu May 11, 2006 8:44 am

It starts today with the weather being cool rainy and windy. Then i get a call from my wife who was on her way to work and was involved in a five car accident. According to the police someone lost control spun two lanes over in front of her she trys to change lanes and hits the brakes gets rearended and smacks into someone in front of her. The thing was she was only 1/4 mile from her exit when it happened. She refuses to go to the emergency room and finally after arriving home i convince her to at least go to an urgent care. I have to pay the entire cost of the visit because it was a motor vehicle accident and my insurance won't touch it. I go to pick up her presciptions and find out that she was dropped from my insurance yesterday. I was never informed of this naturally. I call the benefit rep from work who tells me he is swamped and will get right back to me. Of course he never calls me back. I hate to get a lawyer in this matter but I know the insurance company of the person at fault will more than likely not cooperate. She is looking at two days or more of work missed and I am already going to miss tomorrow, plus rental cars, medical expenses, and making payments on a vehicle you cannot use. I am afraid to go take a leak, something may fall off the way things are playing out today. Anyone else have a crappy day like this lately?

Sorry to hear of the trouble. If she was not seriously hurt, then it's a blessing, even though it still sucks. Things can be replaced, people cannot.

...best of luck and get a lawyer, you will need one more than likely.

Oh what a bummer, enz. Sorry to hear this complicated web of crap. Keep on the insurer's tail, even if it's lots of phone calls. I hope a lawyer is not needed.

Looks like it is heading towards the lawyer thing, talked to the guy's insurance today who was at fault and they are going to fight it tooth and nail saying he isn't to blame. He claims he was side swiped as the reason he lost control. Although only a little scratch was on his rear quaterpanel at the accident scene. How much you want to bet he now has a giant sctatch there now?

I'm really sorry. Keep calling your rep. make him tell you what's going on with your medical insurance. You don't have auto insurance I guess, that's going to cost you. The guy your wife hit will probably sue her and you might have to sue whoever hit her to come out close to even. I'm not sure that you can get the guy that caused the accident. I'm at the end of a lawsuit right now and it sucks. Hang in there.

I do have auto insurance but i shouldn't have to turn it over to mine for someone losing control of his car due to excessive speeding and causing an accident. I would be looking at my premiums increasing or being dropped all together after the fact. Don't see how a claims adjuster can investigate an accident 5 or 6 days after it happens and come up with any other conclusion other than what the police did at the scene.

There are a lot of things in life that you shouldn't have to do EZ and it's fine with me if you don't do them. Just remember that you made the choice. Your insurance will go up if you report the accident but it will also go back down if you avoid other accidents for a couple of years. I really think the cost will be less than the cost of a lawyer who will probably tell you to report the accident to your insurance company anyway. If nothing else you should read your policy. You could very well invalidate it by not making a report. What happens than if the person your wife hit sues you?

In my current case my insurance company is paying for my defense. I've had a lawyer for over a year now and I won't have to pay him even if I lose. I rear ended someone who stopped suddenly on the freeway because "the guy in front of him stopped" I hit him at about 15 MPH. There was no damage to his SUV, he assured me he was fine, a year later I get served. My insurance company had analyzed the accident and determined that they had paid him enough, 50K, now this guy's lawyer is going after my personal assets and my insurance company is defending me and because they made the decisions all the way. Even if a jury awards him a zillion dollars I don't have to pay. Of course they will drop me if I loose but I won't, I hope. It's possible that the jury will award him nothing and he will than have to pay my insurance company all of their expenses back including the 50K. I've seen his medical file and he really could loose but the kind of hell I would be in without my stinking insurance company I don't even want to think about.
