today's local paper had a little clearer explanation. This guy had his files shared on Kazaa

C'mon dude, so you were sophisticated enough to set up a Kazaa account, your files were shared on there and you are trying to play dumb? Guilty. As far as the other stuff in the story, the RIAA isn't going to ever bust anyone for transferring music to their portable mp3 player. Iguessing the Apple lawyers, for one, might step into the fray if that's the case.

This is only a legal opinion being floated in a lawsuit. It means nothing. At the worst, should the RIAA win this lawsuit they could try to claim a legal precedence and sue others.

But at least according to <a href="http://www.theregister.co.uk/2007/12/31/riaa_cds_copies_computer/" target="_blank">The Register</a>, the RIAA has backed off of this position.

Anyone here familiar with a small New York label from the '80s called Proteus? I was listening to one of their releases recently. It came with a little flyer that says -- and I quote -- "The very best sound quality of this album is available only on Proteus Records or Tapes. No home taped version may lawfully be offered for sale. However, home taping to spread the word about this album is encouraged."

So much for home taping killing music. The RIAA would have had a field day with this.

Dear RIAA, never fear. As long as your precious little major labels keep shoving more and more crap like My Chemical Romance and Fall Out Boy down my throat, you shant have to worry about me illegally ripping them to mp3. Or me buying them in the first place.

Great post SS. The statement from Proteus is right on the mark between the polar issues related to copying material. Everyone knows that it can't be stopped (you can't sue everybody!). They point out that there are good and bad points to people sharing content with each other.

I also laughed out loud (in a good way!) at your statement that the shit the majors are putting out is the greatest deterrent to copying. It is a wonderful catch 22.
