A: In his book, "Manchester, England: The Story of the Pop Cult City", Dave Haslam says:

"Blue Monday was really influenced by four songs, he [Bernard Sumner] once told me. 'The arrangement came from 'Dirty talk', by Klein & MBO, the beat came from a track off a Donna Summer LP, there was a sample from 'Radioactivity' by Kraftwerk, and the general influence on the style of the song was Sylvester's '(You make me feel) Mighty real'"


Q: Where does the choir sound come from?
A: Most likely the choir sound on Blue Monday is the same as the sound on Kraftwerk's track "Uranium" (off the album "Radioactivity", 1975). Whether or not New Order sampled Uranium, or used the same sound that was included with the Emu Emulator, is not fully known. Kraftwerk used a Mellotron to create the sound.

That's just what my ear hears.
I don't think Bobby O sucks - I really like a lot of his stuff. "I'm So Hot for You" is a classic.

I think I have a 12" of that Divine song. I'll have to find it. I read an article about Bobby, Divine, that song & New order a couple of weeks ago. I wish I could remember where I read it though!
Supposedly New Order wasn't upset over the copy and played Love Reaction a couple times live when Divine died.
That could be an urban legend in itself though. The internet wouldn't lie would it? [;)]

I thought Killing Joke dropped the lawsuit after Kurt Cobain committed suicide. Jaz felt bad about the band's tragedy. Maybe having Grohl play on their last album is his way of saying, "You're our bitch now!"

Nirvana (again)- the guitar riff from Smells Like Teen Spirit is more than a little similar to Boston's More Than A Feeling.

And I don't know who ripped off who but compare Aldo Nova's "Fantasy" and Jefferson Starship's "Jane".

Joe Jackson's "Pretty Girls" is lovingly reminscent of Manfred Mann's "Do Wah Diddy Diddy."

True: Nirvana ripped off "Eighties".

False: Killing Joke sued Nirvana.

Killing Joke never sued Nirvana for copping the riff in "Eighties". This has turned into an urban myth unfortunately. Some 90's music websites and messageboards have the story the other way around with Killing Joke sueing Nirvana and Nirvana winning the case. Neither is true. Cobain, however, was worried they would sue and the band freely admitted to "borrowing" the riff, which must've satisfied Killing Joke to some degree, but they never pursued a lawsuit. According to a recent Rolling Stone article Grohl and Killing Joke had a laugh about the similarities when he guested on their reunion CD.

That's not to say they should'nt have, as they could've won a case easily.

Nirvana's "Smells Like Teen Spirit" has an awful lot in common with Boston's "More Than A Feeling" but the signature riff in BOTH songs is a direct steal from that old warhorse that EVERYBODY rips off..."Louie Louie".

The Offspring have been involved in a couple of "thefts". First was the cover of the guitar riff from Agent Orange's "Bloodstains" on the Offspring’s "Come Out and Play" (see: http://www.ocweekly.com/ink/00/52/music-kane.php )and the other was a direct steal of the entire vibe of the Beatles "Ob-La-Di, Ob-La-Da" on "Why Don't You Get A Job". What I found hilarious was that when Dexter Holland was asked about the resemblance he took offense!

Actually as a musician, I have seen more than my share of "rip-offs" in studio sessions. There was one very talented studio guitarist who came up with, what he thought, was a great opening for the song he was playing on, but it was actually the piano opening of Bruce Springsteen's "Something In The Night" but played perfectly on guitar. He was not pleased when I pointed it out to him and he didn't believe me until I played the song for him. And they still decided to use the part!

Another time a young guitarist played the intro to the Sex Pistols "God Save The Queen" as another song intro part (again perfectly) , but when I pointed out the problem, he admitted that he was not familiar with the Pistols. Happily, they changed his part.

I guess the point is that a lot of musicians, even pros, are oblivious and incapable of recognizing other people’s riffs and most of the times the producers aren't much better. I attribute most "steals" to ignorance. They aren't really fans of other artist's music; they are self involved and self centered and they think they are above subliminal influence.
