Thing is, Al sold the rights to With Sympathy to Arista back in '83 or '84 to cover studio debts. Al was actually the only member of Ministry to sign the Arista contract, none of the other members had a deal with the label (probably a good thing). At this point, I gotta believe the problem is over at American Beat. They seemed to have already obtained the rights to re-issue, since they allegedly made a new CD with bonus tracks. Of course, Jason just mentioned the 'note in the file', so maybe somehow the release got hung up legally?
Just an edit here, and I hope he doesn't mind me quoting him, but ex-Ministry (1981-83) keyboardist Robert Roberts posted these comments in a current With Sympathy thread over on prongs/ministry:
"My understanding is that Al had testified in a deposition that he had sold the WS royalties in the summer of '83 to help finance the tour..So unless he bought back those songs, as he has claimed, they no longer belong to him.."
"Arista didn't force Ian Taylor on Al. Taylor and Al and Vince Ely all knew each other from when Special Affect opened for the Psyche Furs. Al got to choose the Producer and the Studio.."
"But then WS went over budget, didn't chart as high as expected. Al sold his stake in WS to cover debt and then parted ways with Arista. It not much more complicated than that.."
"Al sold the rights to the WS songs to Arista to help finance the WS Tour and part of financing the tour was paying the band. This is according to his testimony in a deposition.."
"I've never seen a royalty check for anything. Then again, I've never signed any contract with Arista or Ministry."
Can't remember if I posted this link before, but if you ever want to get some great insight on the early Ministry years, check out this interview with Roberts, conducted by bisquitodoom over at the same site:
